In insuring that her client’s future employment, housing and immigration status are not detrimentally affected, Atty. Castaneda files on behalf of her clients a motion to reduce a felony conviction to a misdemeanor and/or expungement. To date, no motion for a reduction of a felony conviction to a misdemeanor and motion to expunge a criminal conviction have been denied by the courts. As one client recently stated, “Atty. Castaneda is patient, respectful and is willing to fight for my case to make sure I get the results I want. She is the Johnnie Cochran of the Filipino community.”
The client and a co-defendant were charged with trafficking narcotics and facing prison time. Atty. Castaneda provided the prosecution extensive mitigating factors in her client's case which resulted in the government making an offer of a misdemeanor charge with no jail time to her client. Also benefiting from her efforts was the co-defendant who subsequently accepted the government's offer.
The client retained Atty. Castañeda to assist her in possible violation of the company’s relocation policies. As a result of Atty. Castañeda’s knowledge of the Fair Credit Reporting Act and employment practices, she was able to reach a disposition prior to filing a civil complaint. Her client received an equitable monetary settlement which allowed her to purchase a home in the competitive housing market of Northern California.
